I used crystal disk info for the first time and it said that the health status is: Caution and that there were 40 current pending sector count
and 40 uncorrectable sector count
Then I checked Hard disk sentinel and it showed me that they are 32 and not 40 and that the health is 52%.
So I rechecked crystal and the number changed from 40 to 32

Now I'm currently doing a surface test and while doing it I checked back again and is said that there are only 24 bad sectors and the health is 62%
So is the hard disk failing? or can it be repaired? it's been like a year since I bought it

You can be never sure that a drive is "failing" at this point. It is far from perfect - but additional tests would be required to
- reveal possible errors/problems (which may currently affect unused sectors so the drive may even not yet notice them)
- stabilize problems: replace possible bad sectors with spare sectors
- restore the status of weak sectors to normal
And then you can tell if the drive is stable (so can be used) OR is failing and would be better to replace.
As you can see, some of the above may happen automatically (this is why the amount of pending sectors already changed) but generally the tests of Hard Disk Sentinel are recommended: not only because they are intensive (performs scan / repair of the complete disk area) but also because they are sensitive enough to show problems, monitor the operating consitions (eg. temperature, performance, health, new errors, retries etc.)
